These Terms of Service ("Terms of Service" "Terms of Use" or "Agreement") govern your access and use of our websites (“Jobsaworld Website(s)” or “Website(s)”) and the Services offered therein (as defined below). The “Jobsaworld” brand, Websites and Services, are owned and developed by Jobs Moving Life Ltd. or any of its owners, subsidiaries, divisions, affiliates, officers, directors, employees, agents, representatives, or licensors(“Company” or “us”).

1.  Acceptance of these Terms of Use and Eligibility

These Terms of Service are a legally binding and enforceable agreement between you, a visitor of our Website, including job seekers that have created an account and registered to our Services ("Job Seeker" and collectively "you") and the Company.

By: (i) visiting or otherwise browsing or using the Jobsaworld Websites and Services; or (ii) creating an Account, filling out your information and clicking “Get Started” (or any similar language); you represent, warrant and acknowledge you have read,agreed with and accept all of the terms and conditions contained in these Terms of Service, which includes those terms and conditions expressly set out below and those incorporated by reference (including those provided to you by email as part of our communications while using the Services). It is your sole responsibility to read the Terms of Service or any other applicable information and policies provided by the Company.  If you do not agree to all or part of these Terms of Service, or if any limitation under any applicable law prevents or limits your ability to be bound by these Terms of Service or any part thereof, you may not visit our Website, create an Account, or use the Services in any manner. 

In addition, by visiting or using the Jobsaworld Websites or Services you explicitly state that, you are in full compliance of any law applicable, including without limitation, any applicable law regarding limitation applied on your ability to enter into agreements or using or visiting the Jobsaworld Websites or Services due to your age or any other applicable limitation. You further represent and warrant you are at least eighteen (18) years old (or at the minimum age to be defined as an "adult" in your jurisdiction).

2.  Our Website & Scope of Services

Our Jobsaworld platform offers certain jobs seeking related services which includes, among others (and depending on the applicable package you have decided to purchase or otherwise obtain): (i) match Job Seeker's CV/resume with open positions in certain territories which we consider, at our discretion, to be applicable destinations for expat workers, in order to update you on job opportunities made public by third party employers or agencies ("Offerors" and "Job Opportunities", respectively), we believe will match your qualifications or preferences using our automated aggregation tools. ("Platform"); (ii) registration to certain courses intended to provide you with guidance, tools or other qualifications related to job interviews and job opportunities, offered and provided by third-parties ("Third Party Services"). Note that, the participation in these Third-Party Services might be subject to additional terms, agreements and policies on behalf of the applicable third parties. In addition, the content and type of certificate under such Third Party Services is subject to those third party providers discretion; (iii) editing CVs (collectively the "Services").

In order to use our Services, you will be requested to sign up and create an account ("Account") via our Website and upload your CV/resume and additional information regarding the requested job position. The information you provide us during the sign-up process as well as in connection with your Account will be processed in accordance with our Privacy Policy, therefore, we advise you to read the Privacy Policy carefully in order to better understand how we will process your Personal Data (as such term is defined in the Privacy Policy). You hereby represent and warrant you will provide accurate and complete information. In the event of untrue or inaccurate information, the Company may suspend or terminate the Account, at its sole discretion and without notice or liability. During the registration, you will designate personal and exclusive user name and password to access the Account, or otherwise be provided with such credentials on behalf of the Company. You are solely and fully responsible for maintaining the confidentiality of the password and username of your Account and for all activities that occur under the Account, including if made on your behalf. Unauthorized access or use of the Account or Services must be immediately reported to the Company. You may not assign or transfer your rights or delegate your duties under the Account, including your username and password, without the prior written consent of the Company.

PLEASE NOTE THAT THE COMPANY IS NOT ACTING AS AN EMPLOYMENT AGENCY BY OFFERING THE PLATFORM AND SERVICES. THE COMPANY IS NOT PROCURING JOB SEEKERS FOR EMPLOYERS OR PROCURING OPPORTUNITIES TO WORK FOR JOB SEEKERS NOR ACTING ON BEHALF OF ANY THIRD-PARTY EMPLOYER.The Company is solely using its tools to match your CV with applicable Job Opportunities made public by third party Offerors, in order to expose the Job Seeker to Job Opportunities. The Company is not responsible for any Job Opportunities, their content and requirements, which are subject to the Offerors sole discretion. Not all Job Opportunities indicate the employer is offering sponsorship to foreign applicants. The decision of whether to offer sponsorship to a foreign employee is entirely at the employer’s discretion. In addition, the Company is not responsible for any requests for interviews or offers made, issues arising from an acceptance or denial of employment, or your rights related to applicable employment, equality or discrimination legislation, which are at the sole responsibility of the Offerors.

Our Website may further include comprehensive information and resources about our business operation and Services, and any other content related thereto, including, inter alia, articles, images, text, logos, button icons, links, and other features (collectively the “Content”).  Please note that the Content is not and shall not be considered as professional employment related advice and it is intended solely for informational and marketing purposes. The Websites may further include third parties' content as well as allow you to access third party websites. Your access to and use of any third-parties' content and websites, including any goods, services or information made available from such websites, is governed by the terms and conditions found at each third-party website, if any.

3.  Fees and Payments

As the Company does not act as an employment or recruitment agency, the charged fees are solely in consideration for the benefit of using the Platform and Services according to the scope of services, features and packages, you wish to be provided with (“Packages”), or other "stand alone" products. The price and features of each Package shall be as offered by us through our communications with you or other documents we provide ("Fees").

Payment of all Fees and charges to the Company must be made by a valid credit or charge card and/or other forms of accepted payment as designated on the Website ("Paid Products"). You acknowledge that the Company may, at its sole discretion and without prior notice, condition the use (of all users or a group of users or your use specifically) of any part or all of its Services, to include payments, to exclude payments, change or modify such Paid Products, turn unpaid products into Paid Products, and vice versa. Fees and payments are not refundable, except as set forth below.

In case that the Paid Products you have purchased was sold on "stand alone" basis and not as one Package, you have a right to a fourteen (14) day Cooling-Off Period in accordance with applicable consumer law (“Cooling Off Period”). The Cooling Off Period shall apply from the date you purchased the Paid Product. However, if you use the Services in any way, you hereby agree that you forfeit the right to cancel during the Cooling Off Period and are not entitled to receive a refund. It is hereby clarified that if you purchased a Package, you shall not be entitled to any Cooling Off Period.

The Company reserves the right to use third party electronic payment processors and/or financial institutions to process payments made by you in connection with your use of the Services.

In any case of suspected or fraudulent payment, including use of stolen credit cards, or any other fraudulent activity (including any charge-back or other reversal of a payment), the Company reserves the right to block your Account and reverse any refund made, if any. The Company shall be entitled to inform any relevant authorities or entities (including credit reference agencies) of any payment fraud or otherwise unlawful activity, and may employ collection services to recover payments.

If any problem regarding any subject occurs, including financial reimbursement, please do not hesitate to contact our Customer Service Department by email at csr@jobsaworld.com or by phone at +44-20-3150-2049. In case of solving the problem unilaterally by the customer through cancellation of transaction by the bank or credit card company, we reserve the right to contact the bank and submit a re-presentment letter in order to claim for the funds back. The Company may, at its sole discretion, cease to provide the Services to certain users or to users paying with certain credit cards.

4.  No Guarantee & Disclaimer of Liabilities

The Company makes no representations or guarantees regarding the effectiveness of the Services or timeliness of the Services in meeting your employment objectives. The Company does not guarantee that all Job Opportunities will meet your needs requirements nor that the Services will result in Job Seekers being hired, invited to an interview, that positions being filled or employees being retained, and is not responsible or liable for any business, employment, hiring and/or salary decisions, for whatever reason made.

THE JOBSAWORLD WEBSITES, PLATFORM SERVICES AND CONTENT ARE PROVIDED 'AS IS', WITH NO WARRANTIES WHATSOEVER; THE COMPANY AND ANY OF ITS OWNERS, SUBSIDIARIES, DIVISIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS OR LICENSORS DO NOT, EITHER EXPRESSED, IMPLIED OR STATUTORY, MAKE ANY WARRANTIES, CLAIMS OR REPRESENTATIONS WITH RESPECT TO ANY OF THE JOBSAWORLD WEBSITES PLATFORM SERVICES AND CONTENT, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR USE OR A PARTICULAR PURPOSE. THE COMPANY AND ANY OF ITS OWNERS, SUBSIDIARIES, DIVISIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS OR LICENSORS FURTHER DO NOT REPRESENT OR WARRANT THAT THE JOBSAWORLD WEBSITES PLATFORM SERVICES AND CONTENT WILL ALWAYS BE AVAILABLE, ACCESSIBLE, UNINTERRUPTED, TIMELY, SECURE, ACCURATE, RELIABLE, COMPLETE AND ERROR-FREE OR WILL OPERATE WITHOUT PACKET LOSS, NOR DO THE COMPANY AND ANY OF ITS OWNERS, SUBSIDIARIES, DIVISIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS OR LICENSORS WARRANT ANY SUCCESS OR ACCEPTANCE OF A VISA THROUGH ANY OF THE JOBSAWORLD WEBSITES OR SERVICES. WE HEREBY EXPRESSLY DISCLAIM ALL LIABILITY IN RESPECT OF ACTIONS OR OMISSIONS TAKEN OR NOT TAKEN BASED ON THE SERVICES AND CONTENT. ANY USE OF OUR WEBSITES, SERVICES AND CONTENT SHALL BE AT YOUR SOLE RESPONSIBILITY AND RISK.

The Company's employees are not authorized to make modifications to the Terms of Service, or to make any additional representations, commitments, or warranties binding on the Company, except for those made in writing signed by an authorized officer of the Company.

5.  License & Restrictions of Use

We hereby grant you with a limited, terminable, non-exclusive right to access and make personal use of the Service solely for your personal noncommercial use seeking employment opportunities for yourself. You hereby declare and agree that you are solely responsible for the any information or contact you post through the Service or provided to us.

You hereby agree that you will not, directly or indirectly: (i) download (other than page caching) or modify our Services, or any portion of it; (ii) resale or commercially use the Websites or Services or its contents; (iii) make any derivative use of the Websites or Services or its contents; (iv) make any use of data mining, robots, or similar data gathering and extraction tools; (v) reproduce, duplicate, copy, sell, or otherwise exploit for any commercial purpose the Websites, Content and Services; (vi) frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Websites or Services or any part thereof; (vii) use the Company’s logo or other proprietary graphic or trademark (including Jobs across the world's name), without the Company’s express written permission; (viii) intercept or monitor, damage or modify any communication which is not intended for you; (ix) use any type of spider, virus, worm, Trojan-horse, time bomb or any other codes or instructions that are designed to distort, delete, damage or disassemble any of the Jobsaworld Websites or Services or the communication; (x) send any unsolicited commercial communication not permitted by applicable law; (xi) expose any other user to material which is offensive, harmful to minors, indecent, unlawful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offense, violate the rights of others, or otherwise violate any applicable local, state, national or international law or otherwise objectionable.

6.  Intellectual Property

The Websites and any of the Services, and any part thereof, including without limitation logos, text graphics, texts, buttons, icons, images, videos, sounds, names, 'look and feel', source code and any and all intellectual property, embodied in the same, including, copyrights, patents, trademarks, titles, or other proprietary information and/or any techniques, algorithms, methods or processes contained in such, in whole or in part, in any form, including without limitation, any component, modification, extraction or development thereof made by the Company (and excluding any third parties' content), constitute our trade secrets, proprietary information and intellectual property (as defined by applicable laws and regulations), and are protected as such by these Terms of Service or by any applicable law.

You shall not make any use of the Company's proprietary information and nothing in these Terms of Service shall be construed as giving you any license or approval to make any use of the Company’s proprietary information. You shall not undertake, cause, permit or authorize the modification, creation of derivative works, translation, reverse engineering, decompiling, disassembling or hacking of any of the Websites, Services, Content or any part thereof.

These Terms of Service does not limit any rights that the Company may have under trade secret, copyright, patent or other laws.

7.  Limitation of Liability

YOU ACKNOWLEDGE AND AGREE THAT THE COMPANY, ITS OWNERS, SUBSIDIARIES, DIVISIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS OR LICENSORS SHALL HAVE NO LIABILITY IN CONNECTION WITH OR ARISING FROM YOUR USE OR VISIT OF ANY OF THE JOBSAWORLD WEBSITES OR SERVICES.

IN NO EVENT SHALL THE COMPANY, ITS OWNERS, SUBSIDIARIES, DIVISIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS OR LICENSORS BE LIABLE, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER FORM OF LIABILITY, FOR ANY INJURIES, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION ANY LOSS OF DATA, INTERRUPTION, COMPUTER FAILURE OR PECUNIARY LOSS) ARISING OUT OF THE VISIT OR USE OF ANY OF THE JOBSAWORLD WEBSITES OR SERVICES OR INABILITY TO USE SUCH, EVEN IF THE COMPANY, ITS OWNERS, SUBSIDIARIES, DIVISIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS OR LICENSORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOUR ONLY RIGHT OR REMEDY WITH RESPECT TO ANY DAMAGE, PROBLEMS OR DISSATISFACTION IN CONNECTION WITH ANY OF THE JOBSAWORLD WEBSITES OR SERVICES OR THE USE OR VISIT THEREOF IS TO CEASE USE OF SUCH JOBSAWORLD WEBSITES OR SERVICES.

If, notwithstanding the other provisions of this Agreement, The Company is found to be liable to you for any damages or loss which arises out of or is any way connected with the use of the Websites or the Services, the Company's liability shall in no event exceed the lesser of (a) the Fees paid by you for the Paid Product; or (b) $50.00 (United States Dollar). As some jurisdictions do not allow some of the exclusions or limitations as set forth above, some of these exclusions or limitations may not apply to you. In such event the liability will be limited as far as legally possible under the applicable legislation. In any case, all warranties or guarantees given or made by the Company with respect to the Services (a) are for the benefit of registered users of the Services that comply with the terms of the Terms of Service only and are not transferable, and (b) shall be null and void if you breach any terms or conditions of the Terms of Service.

8.  Indemnification

You agree to indemnify, defend and hold harmless the Company, its owners, subsidiaries, divisions, affiliates, officers, directors, employees, agents, representatives, suppliers or licensors, from and against all demands, losses, expenses, damages and costs, including reasonable attorneys' fees, made against the Company by any third party due to or arising out of or in connection with your visit or use of the Website or Services.

9.  Modifications and Updates

The Company has the right at any time and for any reason to modify or discontinue any aspect or feature of any of the Services, including but not limited to its content, functionality, availability, or its pricing. Changes of prices and features will not apply retroactively to a Package you have purchased.

Without derogating from the above said, the Company, at its sole discretion, reserves the right to add additional features or functions, or subtract or change such or to provide programming fixes, updates and upgrades, to any of the Services. You acknowledge and agree that the Company has no obligation to make available to you any subsequent or previous versions of any of the Services.

In addition, the third parties providing the Third-Party Services might also modify or discontinue any aspect or feature of any of the Services, including but not limited to its content, functionality, availability, or its pricing, at their discretion and according to their policies.

10.  Privacy Policy

We respect your privacy and are committed to protect information you share with us. We believe that you have a right to know our practices regarding the information we collect when you connect to, access or use the Services and Websites. If you are a potential employer and we have provided you with access to Job Seeker's information which may include certain Personal Data (as defined under applicable privacy and data protection laws and regulations (including, where applicable, EU General Data Protection Regulation (Regulation 2016/679) and the California Consumer Privacy Act (Cal. Civ. Code §§ 1798.100 - 1798.199)) as may be amended or superseded from time to time ("Data Protection Laws"), you hereby guarantee to access and process the Personal Data only in order to assess the applicability of the Job Seeker to your needs and to propose positions to Job Seekers, or as otherwise permitted under Data Protection Laws. You further declare that you have implemented and maintain appropriate physical, technical and organizational measures to protect the Personal Data as required under Data Protection Laws to ensure lawful processing of the Personal Data and safeguard from unauthorized, unlawful or accidental processing, access, disclosure, loss, alteration or destruction.

11.  Termination

Without limiting other remedies, the Company may limit, suspend, or terminate your use of the Services (including Paid Products) and delete your Account at any time, with or without cause and without any recourse, with immediate effect and without any prior notice. Where applicable and required under applicable laws, we will offer a refund for the Paid Products. The Company shall not be liable in respect to any damage caused by or arising from or in connection with the termination or suspension or restriction, regardless of the reason thereof.

You may terminate the Services solely by contacting our customer service available by email at csr@jobsaworld.com or by telephone at +44-20-3150-2049 and subject to any additional terms set forth herein.

12.  Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or its subject matter or formation. Any cause of action you might have relating to the Websites and Services is limited in time to one (1) year from the arising incident, and will be permanently barred afterwards.

13.  Miscellaneous

Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

We may, at our sole discretion, amend the Terms of Service at any time by posting the amended Terms of Service on the relevant Jobsaworld Websites, and/or Services. Any amended Terms of Service shall govern new user registrations from the date that it is posted on such Website. Existing users shall be bound by the amended Terms of Service after the expiry of 14 days following the date of the posting of the amended Terms of Service in the Jobsaworld Websites, and/or Services and your continued use of the Services following such date shall mean that you accept and agree to the amendments. Solely in the event of material changes, and where applicable and required under applicable laws, we will offer a refund for the Paid Products.

The original English version of the Terms of Service may have been translated into other languages. In the event of inconsistency or discrepancy between the English version and any other language version of the Terms of Service, the English language version shall prevail.

If any provision of the Terms of Service is invalid or unenforceable under applicable law, then it shall be, to the minimal extent possible, deemed omitted and the remaining provisions will continue in full force and effect.
